Welcome to industrial.ae. These Terms of Use (“Terms”) govern your access to and use of our website (industrial.ae) and related services (collectively, the “Portal”), operated by Industrial.ae FZ‑LLC.

By using the Portal—whether by browsing, listing, subscribing, uploading, or otherwise—you fully accept these Terms. If you have a separate Advertising Agreement with us, that agreement supersedes these Terms to the extent of any conflict.

1. Key Definitions

“You” or “User” refers to you, whether as an individual or entity that accesses or uses the Portal.
“Listing” means an advertisement or posting for an industrial property (e.g. warehouse, factory, logistics site) for sale, lease, or promotional display.
“Submitted Content” refers to all text, images, videos, maps, floor plans or other materials you upload, create, or otherwise submit via the Portal as part of a Listing or otherwise.
“Product” means the Portal, Listings, Submitted Content, layout, search tools, analytics, marketing features, and any derivative or linked components.

2. Acceptance & Updates

You represent and warrant that you are at least 18 years old and legally able to enter into contracts.
We may revise these Terms at any time by updating the version here or notifying you electronically. Your continued use constitutes acceptance of the revised Terms. (Property Finder)

3. Permitted Use

You may use the Portal to:

View industrial property Listings posted by others.
Upload, manage, edit, and remove Listings that you own or represent.
Access analytics, inquiries, and tools related to your Listings—subject to any paid plan you subscribe to. (LoopNet)

You may provide hyperlinks to industrial.ae only to the Portal’s homepage or your Listings, subject to further request or restriction by us. (LoopNet)

4. Prohibited Use

Unless expressly permitted, you must not:
a) Copy, distribute, reproduce, loan, sublicense, or resell any part of the Product, or create any competing service or database.
b) Use robots, spiders, scrapers, data‑mining tools, or reverse-engineer any feature or structure of the Portal.
c) Upload or post content that is unlawful, infringing, defamatory, misleading, obscene, harassing, or harmful.
d) Use the Portal to promote or facilitate fraud, spam, or unsolicited marketing.
e) Infringe any third-party intellectual property, or impersonate individuals or misrepresent affiliations. (Property Finder, Bayut)

Violations may result in immediate termination of your access (see Section 7).

5. Fees & Plans

Paid Listings or access plans may be required to market your industrial property or access premium tools.
All subscriptions automatically renew unless cancelled at least 3 days before renewal.
Fees are non‑refundable, even if canceled mid‑term. (Property Finder)
We reserve the right to adjust fees at any time; for annual plans, we may increase rates based on UAE inflation indices (as a proxy for CPI-like adjustments).
You authorize us to charge stored payment methods—including for back payments or overdue balances. (LoopNet)

6. Listings & Submitted Content

You are solely responsible for the accuracy, completeness, and legality of all Listings and Submitted Content you upload. For instance, descriptions, floor plans, and pricing should reflect true information. (LoopNet)
By submitting content, you grant us a non-revocable, perpetual, royalty‑free, worldwide license to use, reproduce, display, adapt, distribute, and promote it, now known or developed later, without compensation to you. (LoopNet)
You waive any moral or attribution rights in your content. (LoopNet)

Company has no obligation to monitor Listings, but reserves the right to review, modify, or remove any content at its sole discretion, including upon violation reports. (LoopNet)

7. Term & Account Termination

We may suspend or terminate your access at any time—without notice—if we determine you’ve violated these Terms or engaged in unlawful activity. (LoopNet)
Upon termination, you must stop using the Portal and delete any downloaded content within 10 business days, certifying deletion upon request. (LoopNet)
You agree not to enforce similar user-supplied agreements against us, and we reserve remedies including injunctive relief. (LoopNet)

8. Security & Passcodes

Protect your Portal access credentials (username, password, One-Time Passwords) and do not share them.
Unauthorized use or circumvention of security mechanisms may result in loss of access and legal consequences. (LoopNet)
Notify us immediately if you suspect unauthorized access to your account.
We make no guarantee regarding uptime, speed, or data backup; regular local archiving of your data is your responsibility. (LoopNet)

9. Intellectual Property Complaints

If you believe content on the Portal infringes your intellectual property, please contact our team with a notice providing:

Your signature (electronic accepted)
Description of the infringing work and location
Contact details
A declaration of good-faith belief and accuracy under penalty of perjury

10. Disclaimers & Limitations of Liability

The Portal is provided “as is”, with no warranties of accuracy, merchantability, legality, or fitness for any purpose. (LoopNet)
We do not guarantee Listings represent actual availability or condition of a property. Always perform your own due diligence.
To the fullest extent permitted under UAE law, we are not liable for any indirect, incidental, consequential, or special damages, or loss of revenue, even if advised of potential damages. (LoopNet)
In any dispute, our cumulative liability is limited to the total fees paid by you in the 12 months preceding the claim. (LoopNet)

11. Indemnity

You will indemnify and hold us harmless from any third-party claims, damages, losses, or expenses (including legal fees) arising from:

Your Listings or Submitted Content
Your misuse of the Portal or violation of these Terms
Your breach of applicable laws or third-party rights. (Property Finder)

12. Governing Law & Dispute Resolution

These Terms are governed by the substantive laws of the Dubai International Financial Centre (DIFC), UAE. Any dispute arising hereunder shall be resolved exclusively in the DIFC courts, unless you and we agree to mediation or arbitration. (Property Finder)

13. Modifications

We may modify the Portal—including features, layout, or availability—at any time with or without notice. We are not liable for changes, interruptions, or discontinuation of the Portal or any features. (LoopNet)

14. Miscellaneous

Language: The English version governs. Any translation is for convenience only. (LoopNet)
Entire Agreement: These Terms, together with any Advertising Agreement and Privacy Policy, constitute the whole agreement between you and us.
Severability: If any part is invalid under applicable law, the remainder still applies.
Force Majeure: Neither party is liable for delays or failure due to events beyond control (e.g. energy outage, governmental intervention, acts of God). (LoopNet)
